Terms of Service – EVERLY TORONTO

Article 1 – Definitions

In these Terms of Service, the following definitions apply:

Withdrawal Period: The time frame in which the customer may exercise the right to withdraw from the purchase.

Consumer: A natural person who is not acting on behalf of a business or profession and who enters into a distance contract with the merchant.

Business Day: A calendar day excluding weekends and federal holidays in Canada.

Distance Contract: A contract concluded between EVERLY TORONTO and the customer within the framework of an organized system for online sales, where communication and conclusion occur exclusively through digital means.

Durable Medium: Any means that allows the customer or merchant to store information in a way that enables future access and unchanged reproduction.

Right of Withdrawal: The customer’s right to cancel the purchase within the withdrawal period.

Merchant: EVERLY TORONTO, which offers fashion products online to consumers within Canada.

Terms: These Terms of Service governing all transactions and interactions between EVERLY TORONTO and the customer.

Article 3 – Applicability

These Terms of Service apply to every offer from EVERLY TORONTO and to every online purchase agreement made between EVERLY TORONTO and the customer.

Before finalizing an online order, customers will have access to these Terms of Service. By completing a purchase, the customer acknowledges and agrees to these terms.


Article 4 – The Offer

If an offer has a limited duration or is subject to specific conditions, this will be clearly stated.

All product descriptions and images are presented as accurately as possible. However, slight variations in color or appearance may occur depending on device displays.

Obvious errors or mistakes in pricing or descriptions are not binding.

Each offer includes a clear description of applicable rights and obligations, such as pricing, delivery, payment methods, refund policies, and applicable warranties.


Article 5 – The Contract

A contract is concluded at the time the customer completes the checkout process and payment is confirmed.

EVERLY TORONTO will immediately confirm receipt of the order electronically.

We use secure technology to protect all personal and payment data transmitted during checkout.

If necessary, EVERLY TORONTO reserves the right to refuse an order or request additional verification before processing.

Once the order is shipped, the customer will receive confirmation and tracking details via email.


Article 6 – Right of Withdrawal

Customers have the right to withdraw from their purchase within 30 days of receiving their order, without the need to provide a reason.

During this period, items must be handled with care and may only be tried on as reasonably necessary to determine fit or suitability.

To exercise the right of withdrawal, customers must notify EVERLY TORONTO via email at info@everlytoronto.com within the 30-day period and ship the return within 30 days after notification.


Article 7 – Return Costs and Refunds

Return shipping costs are the responsibility of the customer.

Once the returned item is received and inspected, EVERLY TORONTO will process the refund within 14 days using the original payment method.

Returned items must be in their original condition, unworn, and with all tags attached.


Article 8 – Exclusions from the Right of Withdrawal

The right of withdrawal does not apply to:

  • Personalized or custom-made items

  • Intimate apparel or items that cannot be returned for hygiene reasons

  • Items purchased on final sale or marked as non-returnable

  • Gift cards or digital downloads


Article 9 – Pricing

All prices are listed in Canadian dollars (CAD) and are subject to change without notice.

Prices include shipping within Canada.

Sales tax (HST/GST/PST) may apply depending on the customer’s location and will be calculated at checkout.

EVERLY TORONTO is not responsible for typographical errors in pricing.


Article 10 – Product Quality and Warranty

EVERLY TORONTO guarantees that all products meet reasonable expectations of quality and match their descriptions.

If a product is defective or does not meet these expectations, please contact info@everlytoronto.com within 14 days of delivery with photos and a description of the issue.

Warranty does not apply to damages caused by improper use, neglect, or unauthorized alterations.


Article 11 – Shipping and Delivery

We process and ship all orders within 1 business day after payment confirmation.

Delivery times within Canada typically range between 8 and 14 business days.

In the event of delays or stock shortages, customers will be notified via email.

If an item becomes unavailable, EVERLY TORONTO may offer an alternative of equal value or a full refund.

Responsibility for the package transfers to the customer upon confirmed delivery by the shipping carrier.


Article 12 – Duration and Termination

Contracts for individual product purchases end once both parties have fulfilled their obligations.

In the case of ongoing subscriptions or preorders, customers may cancel with at least one month’s notice before renewal (if applicable).

Trial or promotional orders automatically terminate after fulfillment.


Article 13 – Payment

Payments must be made at the time of ordering using one of the payment options available on our website (such as Visa, Mastercard, American Express, Shop Pay, Apple Pay, or Google Pay).

In case of payment errors or disputes, customers must contact our support team immediately.

Failure to complete payment may result in order cancellation.


Article 14 – Complaints

Any complaints must be submitted in writing via email to info@everlytoronto.com within 7 days of receiving the product.

We will respond to all complaints within 14 business days. If more time is required, we will notify the customer of the expected resolution date.

Submitting a complaint does not suspend the customer’s payment obligations.

If the complaint is found to be valid, EVERLY TORONTO will replace, repair, or refund the affected item at no additional cost.


Article 15 – Governing Law

All purchases and agreements between EVERLY TORONTO and its customers are governed by the laws of Canada and the Province of Ontario.

Any disputes shall be handled in accordance with Canadian consumer protection standards and the applicable laws of Ontario.
